1. Acceptance of Terms

By accessing and using DevThumbs ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

DevThumbs provides a screenshot API service that allows developers to programmatically capture website screenshots. The Service includes, but is not limited to:

• Website screenshot capture via REST API
• PDF export functionality
• Scheduled screenshot captures
• Custom JavaScript injection
• Webhook notifications

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. API Usage and Rate Limits

Your use of the API is subject to rate limits based on your subscription tier:

• FREE tier: 10 requests per minute, 250 credits per month
• PRO tier: 120 requests per minute, 10,000 credits per month
• ENTERPRISE tier: Custom rate limits as per agreement

Exceeding rate limits may result in temporary throttling or suspension of service. Systematic abuse or attempts to circumvent rate limits may result in account termination.

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any laws or regulations
• Capture websites without proper authorization
• Harass, abuse, or harm others
• Distribute malware, viruses, or harmful code
• Scrape or extract data in violation of website terms of service
• Engage in any activity that disrupts or interferes with the Service
• Resell or redistribute the Service without authorization

6. Payment and Billing

Subscription Plans: Subscription fees are billed monthly in advance and are non-refundable. You may cancel your subscription at any time, effective at the end of the current billing period.

Credit Top-Ups: Additional credits purchased are non-refundable and do not expire.

Price Changes: We reserve the right to change our pricing. We will provide at least 30 days notice of any price changes.

7. Service Availability

While we strive to provide 99.9% uptime, we do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by DevThumbs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Screenshots captured using the Service belong to you, subject to the rights of the website owners whose content was captured.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVTHUMBS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Subprocessors

DevThumbs uses the following third-party service providers (subprocessors) to help us deliver the Service. These subprocessors may process your data as described below:

We maintain appropriate data processing agreements with all subprocessors and ensure they provide adequate security measures. This list may be updated from time to time. Material changes to our subprocessors will be communicated to affected users.
